Terms of Service

These terms apply to your use of kwkdesignz.com and to every quote, order and purchase from KWK Designs LLC ("KWK Designs," "we," "us," or "our"). By using this site, requesting a quote or placing an order, you agree to them. Our Return and Refund Policy and Shipping Policy are part of these terms.

1. Quotes and Orders

A quote request does not create an order or any obligation. A quote is an estimate based on the details you give us. Your order is confirmed only after you approve the quote and pay the invoice in full.

All custom merchandise requires a minimum order quantity of 50 units. Pricing is subject to change. Reorders, especially in a different quantity than your original run, may be priced differently, and we will always quote you the current pricing before moving forward.

2. Payment

Because every custom order is made to your specifications, 100% of the invoice must be paid before production begins. Cancellations and refunds are covered in our Return and Refund Policy.

Custom designs require a $150 design fee, due upon quote approval. The fee is credited toward your order if you proceed and is non-refundable if you do not. Artwork created for a custom design remains the property of KWK Designs LLC unless released as described in Section 5.

3. Artwork, Proofs and Approval

Production is scheduled only after we receive your final written approval of the digital proof, verifying layout, spelling, colors and dimensions. You are responsible for the accuracy of all information and artwork you provide and approve. Changes requested after final approval may result in additional charges, or may be declined if production is already underway.

4. Artwork You Provide

When you send or upload images, logos, graphics or concepts for an order, you confirm that you have the legal right to use them. KWK Designs LLC does not verify trademark or copyright ownership of customer-submitted designs. If a third party brings a claim against KWK Designs LLC over artwork you provided, you agree to take full responsibility and cover all related legal costs, damages and claims. We are not liable for copyright or trademark infringement resulting from customer requests.

5. Ownership of Molds and Artwork

Molds. KWK Designs LLC retains ownership of all production molds. We keep your molds on file for 24 months after your most recent production run. Reorders after that window require a new setup and mold fee. Molds are used only for orders authorized by you or your designated representative.

Artwork. Design work created or refined by KWK Designs LLC remains our intellectual property and may not be taken to other manufacturers or used commercially without our consent. Exclusive rights to the artwork may be purchased for an artwork release fee of up to $300.

6. Production Times

Turnaround times we quote are estimates. Production can be affected by delayed approvals, material shortages or shipping bottlenecks. KWK Designs LLC is not financially liable for missed deadlines unless a firm, guaranteed delivery date was agreed to in writing before payment.

7. Manufacturing Variances

Because of physical manufacturing and differences in screen calibration, colors on your digital proof may vary slightly from the finished product. Minor variations in color, texture and exact size are standard in the industry and are not defects or grounds for a remake.

8. Shipping and Risk of Loss

Once your order is handed to the shipping carrier, the risk of loss, theft or damage passes to you. See our Shipping Policy for details, including optional shipping insurance.

9. Samples, Portfolio Use and Overruns

We may use photos and physical samples of your custom order in our portfolio, website and marketing. We may also sell or distribute production overruns, misprints or factory seconds through our own channels.

10. Items You Send Us

If you mail us physical items to use as references, templates or materials, you do so at your own risk. KWK Designs LLC is not liable for loss, alteration or damage of those items while in our possession or in transit.

11. Website Content

The KWK Designs LLC logo, website design, photos and branded assets are protected by copyright and may not be reproduced without written permission.

12. Events Beyond Our Control

KWK Designs LLC is not in breach of these terms for delays or failures caused by circumstances outside our control, including natural disasters, severe weather, pandemics, strikes, supply chain disruptions, acts of war or government-ordered shutdowns.

13. Changes to These Terms

We may update these terms from time to time. The version posted on this page when you place your order applies to that order.
